No,you don't get it. The mere fact that he is talking about it now is a good indication that he's already done all the analysis, and knows he can't take any action. So, by coming out and saying he's "examining" it, he continues to keep the issue in the news and gain popularity on it in spite of knowing the law is not on his side.

He has made the political determination, though, that even New York City, which by some estimations has over 1M Jewish people living in it, is fed up with Netanyahu. Which is pretty remarkable.

I think the issue comes from a mayor acting on behalf of a country. You really don't want that kind of thing. I agree Netanyahu needs to be arrested and tried for his crimes. I just don't think a mayor could actually do it without federal approval.

Correct. The US is structured with a hierarchy where federal laws supercede state laws supercede local laws.

The US is not (thanks for the correction) an ICC signatory and is ~~supposedly~~ therefore not obligated to comply with Netanyahu's arrest warrant and ship him to The Hague, ~~but~~ so the ICC can't compel the US federal government to actually do anything about it.

As much as it is a crime drama meme, diplomatic immunity is still a thing and would preclude his arrest (be it for a local law or attempted compliance with the ICC warrant) as long as the fed asserts that he has diplomatic immunity.

So this is a situation where the only practical option available to try to hold him accountable is vigilantism.

Not anymore. Clinton signed the treaty but never submitted it for ratification, so the US technically was never part of the ICC, and Bush "un-signed" it, absolving the US of any responsibilities whatsoever.

There are two reasons he can't do anything.

First is the idea that when the UN chose to place its HQ in New York, the US likely had to agree to safe passage for all diplomats and officials going to the General Assembly. That just makes sense. The UN can't function if the Host Nation gets to control who goes to the meetings.

Second, the US isn't a party to the ICC in the first place, and doesn't formally recognize its jurisdiction. IMO, this is actually the correct position, because the ICC as it is currently run does not guarantee all the protections that US courts grant its citizens, so the US could not subject its citizens to it. (Even Bill Clinton, who signed the treaty at first, acknowledged this and did not send the treaty to the Senate for ratification. George W Bush "un-signed" the treaty a few years later).

So, it really would be impossible for a local police force to arrest a foreign leader with diplomatic immunity on the warrant of a court which is not recognized by the government.

The USA doesn’t recognise the ICC because they do not want their citizens to be subjected to it. There are quotes from senior officials and diplomats essentially saying that the USA agrees with the concept of the ICC but only for lawless countries where people who violate international law are unlikely to be held to account. Essentially it is a humdinger of an example of “rules for thee but not for me” creedo. The US hides behind its UCMJ (Uniform Code of Military Justice) as a panacea excusing it from subjecting itself to the rules it wants to enforce on the rest of the world. The argument is that the UCMJ is sufficient to enforce accountability and international law, and that the ICC is superfluous. It’s a tenuous argument at best and ultimately shelters the USDF from international accountability for their actions.

There are legitimate concerns about American participation in the ICC:

  • the US Constitution guarantees jury trials for major offenses, and the ICC doesn't use them

  • the US Constitution states that the US Supreme Court has appellate jurisdiction over all other courts, and there is no room for an international court to fit in that structure

  • US courts claim jurisdiction over US citizens who commit crimes on US soil, and there is no mechanism to insert the ICC into that.

So it's not just that the US doesn't want to play nice, there are things in the structure of the ICC that violate the US Constitution. Those contradictions would have to be resolved before the US can join, either by changing the ICC or changing the US Constitution.

Talking is realistically all he can do since UN is governed by a pretty complex web of federal law. He'd end up in a standoff with the feds and Mossad. Talking about it is more than any other US politician is doing though.

In a city of billionaires, Mamdani is not owned, which is why they're all so scared of him: the powers that be can't control him, and they can't even predict him.

Which is exactly what makes this so based. Mamdani IS the mayor of NYC. He could make Bibi's arrival in his city a little slice of hell in all manner of ways, many of which would break no law at all, and many New Yorkers would be thrilled to do their part.

But will he? No one knows. And that's the beauty of it. We all know he's thinking about it now.

So whether this pans out in reality or not, it's always good policy to make a motherfucker watch his own back. Mamdani just turned Bibi into a motherfucker with a back that needs watching in NYC.

Yeah why does USA not want international law? The U.S. has never ratified the ICC because why would they give up the freedom to do what they want… USA does not recognize the jurisdiction of the ICC. The 2002 American Service-Members’ Protection Act (ASPA) literally states that the U.S. will attempt to protect U.S. military personnel and other citizens from ICC persecution, even with military action if necessary. That bill was nicknamed “The Hague Invasion Act” because in theory it authorizes the president to use force to free Americans from ICC prison. They even go as far as using big tech to blackmail members of the ICC that investigate war crimes of the US military (or Israel). crazy.

Neither USA nor Israel is among the 125 signatories of the Rome Statute, which established the ICC in 1998. However, the treaty sets out that nationals of non-member states can be tried for crimes that take place on the territory of states that are signatories. But if mamdami arrests netanyahu and delivers him to The Hague that would be a dream for everyone who wants global peace and justice, probably followed by sanctions from crybaby trump tho lmao

As much as I'd like to see it, it's just posturing. Congress has explicitly stated that state and local LEOs cannot recognize or enforce ICC warrants.

What a coincidence! In my household we just went to the bat store yesterday to purchase celebratory bats in case Netanyahu came to visit us! The kids go some heavy gauge plastic ones. I, on the other hand, found a nice, hefty aluminum one with heavy embossing. It has a lot of sharp edges and features that could help turn things around.
