You can absolutely pet the penguins. Just, don't. As far as king and emperor penguins go, anyway, the adult ones have no land predators so they're pretty much completely unfussed about people approaching them.
Another thing, though. People see an African penguin or an Adelie or similar at a zoo and they think all penguins are little cuddly football sized waddlers. I imagine most people would be completely unprepared for the sheer scale of an adult emperor penguin:

You probably shouldn't, but you definitely can. Law enforcement is pretty sparse. As long as you don't bring witnesses or record your crime, you can pet penguins at will. Again, you shouldn't, because it's not good for the penguins.
Hopefully the Venn diagram of people who want to pet penguins and people who care that it hurts the penguins is a circle.
I hope so, too, and there's a good chance of it. It's not very common to accidentally wander into Antarctica. I believe it's population has the highest percentage of PhDs of any continent, most of them in science. While I realize that doesn't guarantee beneficence, I feel like it goes a long way.
Add a circle for people who cant (or wont) atop that too, just to be sure.

Personally I feel like creating a new circle for Aotearoa and labelling it “Prehistoric” would be fitting since many living things on the islands are species that died out everywhere else after the continents split.
A more humorous label to fit with the others could be “Weird birds” since the avian diversity on the islands includes the Kakapo, the Kiwi, and the Kea parrot, all of which are birds that show up in memes
