This is only federal. He still faces murder charges in the state’s case.

[-] homes@piefed.world 24 points 6 days ago

but not the death penalty, as NY does not have the death penalty.

[The Judge] said her analysis may strike ordinary people, and many lawyers and judges, as "tortured and strange," but it "represents the court's committed effort to faithfully apply the dictates of the Supreme Court to the charges in this case. The law must be the court's only concern."

This seems like malicious compliance. The best kind of compliance.

-Federal murder charges and gun charges have been dismissed, but state murder charges have not been (NY state does not have death penalty)

-Federal stalking charges are still in play

-Backpack evidence will be included in the trial

-Including the "manifesto" as evidence

So what's left? Forgery and stalking?

[-] moonshadow@slrpnk.net 10 points 6 days ago

Same charges at the easier to convict state level with a bunch of support from the federal prosecutors who just had their case dismissed. A nice symbolic win though

It takes the death penalty off the table.

And the state charges. I don't expect him to get away without any punishment, and probably shouldn't. There are consequences for taking action. But I'm okay with this finding, and if he gets similar results with the state.

He only deserves to get off without punishment if they butchered the case and collected/planted evidence illegally.

I fully believe they did collect evidence illegally and planted evidence to make it stick.

Why would he ditch his bag after the crime, yet hold on to the worthless 3d printed gun, that could have been disposed of in any NYC garbage can or bag, or anywhere along his trip out. It’s the only thing that concretely ties him to the murder and could be legally collected. If you’ve been to NYC, the streets are often full of garbage bags.

That makes zero sense from a guy who seemingly plotted how to enter the state, where to stay, where his target was going to be, and how he was going to escape plus get home.

Have we already determined guilt? Sure we have the right person?
