As far as I can tell S.3706 the "Communist Control Act of 1954" is still in effect so how can any group even so much as claiming to be communist actually stay functional

I understand the main part is them not actually being revolutionary but I am still kinda curious legally get away with it unless that has been changed in a way I can't find

My 2¢: that law is of questionable constitutionality, and the state doesn’t see the communist parties as a real threat currently, so they don’t bother to test the law.
