Yeah the lawsuit was dumb. Nintendo doesn't own the concept of creature capture. You can't own concepts as far as I know
You can't copyright a concept, but you can patent one. The lawsuit was over patents, not copyrights. They even tried to retroactively apply for more patents to strengthen their case before the lawsuit was over, but they were refused. At least in Japan.
