Ianal but if he shot at him below the waist, he’d likely not get attempted murder. Assault/deadly weapon and whatever charges for discharging a weapon and road raging.

Not true, you might be surprised to learn, but you have arteries down there.
Still might be AWDW instead though, but because (if) the prosecutor feels they're more likely to get a conviction that way, where if they overcharge with Attempted Homicide the guy may actually end up walking free.

No you didn't. The article says where he shot him, not where he aimed. Those are not the same thing. You also conveniently ignored this part.
This was attempted murder. Dude just has shitty aim.
He also followed him for some time, which would make it hard to state this was not premeditated and a moment of passion.
People of Lemmy are just like reddit and want to be experts on all the things they don't know about.
