I'd argue his job is to listen to his constituents, and since through his actions or inactions this person is coming to harm, that he is not listening. Oh I feel you there, what I've started to do is tell them they don't get to complain because they got exactly what they wanted. I remind them that they knew this was going to happen and insist that they knew because I told them as much. Then every time they complain about it repeat that process. They either start listening or stop complaining. Either is an improvement over them complaining about their own choices.
