"Shaken baby syndrome" was a fad medical diagnosis in the 80's and 90's that has led to many miscarriages of justice (e.g. Sally Clark). It has subsequently been widely discredited by most of the Medical community, but that won't stop some prosecuters...

The board can take up until two days before the execution, which is slated for Oct. 17, to make its recommendation.

So wait, if evidence showing this man was innocent appeared on the 16th, they'd still kill him?

Jesus Texas is just one giant miscarriage of justice after another, isn't it?
