In another thread, someone was saying they're in use on a bunch of building sites and are performing without issue, so I suspect it's not as much of a concern as we suspect.
Construction sites aren't usually operating at high speed. Trying to bust through the plow line on a winter day and getting the tires packed with snow will have the car doing the humpy-hump down the highway.
I make you right, but I'm assuming the conditions you've set out are part of the test suite?
Not much of a tire if it can't handle snow or mud at speed.
