I strongly disagree. People walking along roads die every day. It is not safe. That exact situation may not have been foreseeable. But when you add up all of the different possible scenarios and reasons people may drive recklessly, it becomes practically inevitable that something like this will happen. If the only route people have to walk somewhere is along fast traffic, people will die. And if we refuse to develop alternatives (which are very affordable for pedestrian infrastructure) then we are choosing to kill these people by our inaction.
